Competition for the Magic of Asia: Thailand, Vietnam & Cambodia

These terms and conditions govern participation in the competition for the Asia Magic trip. This is a trip that was advertised as part of a competition on the website https://co.uk.sales.secretescapes.com/121948/thailand-cambodia-vietnam/ in the period from 06/01/2025 to 03/02/2025 (“Competition”).

A. ORGANISER AND PARTICIPANTS

1. The organiser is Secret Escapes Ltd, 120 Holborn, London, EC1N 2TD (the “Organiser”).
2. Only persons residing in the UK may take part in the competition (“Participants”). All Participants must be of legal age and legally competent.
3. Employees of the Organiser, its affiliates, their families, agents and other parties directly involved in this competition and the related sponsorship (including employees of AURORA TRAVEL COMPANY LIMITED, its affiliates and their families and agents) are not eligible to participate.

B. HOW TO PARTICIPATE

1. Participation in the competition requires the provision of a valid email address between 06/01/2025 00:01 (BST) (Inclusive)(“ Submission Date ”) and 03/02/2025 at 23:59 (BST) (“Submission Deadline”)(collectively “Qualified Registration”) at https://mp.secretescapes.com/uk/2025/jan-sale/competition/. After a Qualified Registration is made and if the participation requirements set out in sections 1 to 3 are met, Participants can take part in the competition. Persons who register after the submission deadline are not eligible to participate.
2. Incomplete, invalid or email addresses that have already been provided to the Organiser for the purpose of registering for the competition in accordance with section 4 of these terms and conditions do not entitle the participant to participate in the competition. The Organiser accepts no responsibility for registrations that could not be completed successfully due to a technical error of any kind or circumstances beyond its control.
3. The Organiser may reject requests to participate in the competition if the respective participant does not meet the requirements set out in these terms and conditions.

C. THE PRIZE

1. By participating in the competition, Participants can win the following package holiday, bookable between 04/02/2025 and 11/12/2025 (the “Prize”):

   1. A 14-day package holiday for 2 adults to Thailand, Cambodia and Vietnam, as finally described at https://co.uk.sales.secretescapes.com/121948/thailand-cambodia-vietnam/ (the "Package Holiday"). The package holiday cannot be exchanged for another travel offer. The prize cannot be awarded by paying out the value of the aforementioned package holiday, either by means of an electronic means of payment or in cash.
   2. The package holiday includes accommodation for two people in several accommodations including breakfast. Lunch, dinner and snacks are not included and must be paid for separately by the winner.
   3. The package also includes international economy class flights from select UK airports to Bangkok airport and a return flight from Hanoi airport, provided that the total price of the flights does not exceed the amount stated under 7.e) of these terms and conditions. The selection of flights by the Organiser depends on the availability and price of the flights and can therefore vary before the package. All transfers within Thailand, Cambodia and Vietnam are included in the package, including domestic flights in economy class from Bangkok to Siem Reap in Cambodia, Siem Reap to Danang in Vietnam and Danang to Hanoi. Domestic transfers in the UK are not included in the package. Baggage allocation depends on the airline and the flights booked. At least one piece of checked baggage per person is included, whereby the maximum permissible weight of the included piece of baggage is determined by the respective airline. Additional baggage must be paid for by the winner.
   4. International flights are available from these airports depending on availability and price: London Gatwick, London Heathrow, Manchester, Edinburgh, and Birmingham.
   5. The maximum value of the prize for international return flights in economy class is £3,000. If the winner books flights worth more than £3,000, he or she will have to pay the difference. If the flights cost less than £3,000, the remaining amount will be forfeited and the Organiser will not grant a (partial) refund of the remaining amount.
   6. The package tour also includes a visit to the Angkor Temples in Cambodia (day 5), a boat trip and street food experience in Hoi An in Vietnam (day 8), a half-day Hanoi tour (day 12) and a one-day cruise in Ha Long Bay in Vietnam (excluding drinks and other meals) (day 13). The winner can optionally book additional excursions for a fee as part of the booking process.
   7. All guides speak English. The winner can alternatively book a guide who speaks another language for a fee. The winner will be contacted via email by the Secret Escapes travel advisor to book the trip. The winner must make their request during the booking process, stating the travel destinations, travel times and the desired language. The Organiser will then endeavor to request the desired guides. Since the guides are not connected to the tour operator and are external service providers, the Organiser cannot guarantee that the desired guide will be made available.
   8. The package holiday is awarded to the winner on a personal basis and cannot be transferred by the winner or any other person to any other person or awarded to any other person in any other way. The prize may not be sold or offered for sale on the internet, in newspapers or anywhere else. In the event that the prize offered is no longer available or economically or practically feasible due to circumstances beyond the control of the Organiser, the Organiser reserves the right to offer an alternative prize of equal or greater value.
   9. The package holiday is only valid for adults. The winner may not name a minor as another travelling person.
   10. https://www.secretescapes.com/terms-and-conditions apply to the booking and implementation of the package tour.
   11. If the winner requests changes to the trip after booking the package holiday or if such changes become necessary for another reason in the winner's favor, the Organiser will endeavor to implement the requested or necessary changes. However, the Organiser cannot guarantee that these changes will be implemented successfully. If the winner subsequently wishes to cancel the booking, the prize will be forfeited without compensation.
   12. The package tour can be carried out between 02/01/2025 and 11/12/2025. The winner must contact the Organiser immediately after receiving notification of the prize regarding possible travel times.
   13. All dates between 04/02/2025 – 11/12/2025 are subject to availability. The trip cannot be booked on the dates 15/01/2025 – 03/02/2025, 09/04/2025 – 15/04/2025, 23./04/2025 – 28/04/2025, 19/08/2025 – 28/08/2025, 12/12/2025 – 04/01/2026.
2. The winner must contact the Organiser to claim the prize and the Organiser will make the booking with AURORA TRAVEL COMPANY LIMITED. The Organiser accepts no responsibility if the winner does not redeem the stay (in whole or in part) before the prize booking date specified in clause 7 .
3. In the event of circumstances beyond the control or sphere of influence of the Organiser or AURORA TRAVEL COMPANY LIMITED, neither the Organiser nor AURORA TRAVEL COMPANY LIMITED shall be liable for any delays in travel.
4. The winner and their travelling companions are responsible for ensuring that they have a valid passport and all necessary visas for travel, have all necessary travel insurance and meet all other entry requirements for the destination country of the prize. The prize does not include travel insurance or any additional expenses, including spending money. Any other costs in addition to those set out above and incurred in connection with claiming the prize are the responsibility of the winner and not of the Organiser or AURORA TRAVEL COMPANY LIMITED.

D. PRIZE DRAWING AND NOTIFICATION

1. The winner will be randomly selected from among the qualified entries.
2. The winner will be contacted within 30 days of the draw. The winner must inform the Organiser no later than 14 days after receiving an electronic notification of the win by email from the Organiser whether he or she wishes to accept the prize.
3. If the winner refuses the prize or fails to accept the prize in a timely manner in accordance with clause 12, the Organiser has the sole discretion to award the prize to other Participants.

E. DISCLAIMER

1. The Organiser reserves the right to exclude individuals from participating in the competition or to demand the full value of an awarded prize if there are reasonable grounds to believe that the respective winner has won the prize through abusive or criminal behavior or has violated these terms and conditions. The Organiser may require the participant or winner to provide proof that he or she is entitled to participate in the competition.
2. The Organiser is not liable for any losses or damages incurred by a participant in this competition, including in connection with the implementation of the prize. The Organiser is only liable without limitation for other liability claims if a guaranteed quality is missing and for damages due to intent and gross negligence. The Organiser's liability for damages resulting from injury to life, body or health that are based on an intentional or negligent breach of duty by the Organiser and its employees or vicarious agents remains unaffected.
3. Although the competition may be published on Facebook and Instagram, this promotion is not sponsored, endorsed, administered by, or associated with Facebook and Instagram.
4. The Organiser will not accept any competition entries that:

   1. automatically generated by computer or created by artificial intelligence (including, but not limited to, chatbots such as ChatGPT or similar software applications); or
   2. completed by third parties or in large quantities.
5. The Organiser reserves the right to terminate, declare invalid, suspend, cancel or change the competition if this becomes necessary due to circumstances beyond the control of the Organiser or circumstances due to force majeure.

F. PROCESSING OF PERSONAL DATA

1. All personal data collected by the Organiser as part of the campaign will be processed in accordance with the Organiser's privacy policy. Participants can view the privacy policy at www.secretescapes.de/privacy-policy.
2. The Organiser will pass on the Participant’s name and contact details to AURORA TRAVEL COMPANY LIMITED for the purposes of conducting the prize draw, verifying the winner and booking the hotels included in the prize.
3. The Organiser must publish or make available information proving that a valid draw has taken place. To comply with this obligation, the Organiser, with the consent of the winner, will publish the winner's surname, city and country and the prize award ceremony after the date of the draw or send the winner's surname and country to third parties who contact the Organiser for this purpose. The respective winner may object to the publication or provision of their surname, city or county to the person responsible.
